Michigan Switchblade Legalization

Breaking News:  The Michigan Switchblade Legalization Bill – SB245, has been signed by Governor Snyder.

From Michigan.Gov:

Senate Bill 245, sponsored by state Sen. Rick Jones, eliminates current law prohibiting the sale or possession of spring-assisted knives, also referred to as “switchblades”. It is now Public Act 96 of 2017.

I will update as more information becomes available. I am currently trying to decipher the legalese in SB 245 to determine if it is immediate or a 90-day waiting period before this goes into effect. (Update: It is a little consolation that Todd Rathner of Knife Rights is having the same trouble, but it is his opinion upon conferring with a MI Senate staffer that it is in fact a 90-day waiting period until the repeal goes into effect.)

I was/am confused by the following language:

Enacting section 1. Section 226a of the Michigan penal code, 1931 PA 328, MCL 750.226a, is repealed.
Enacting section 2. This amendatory act takes effect 90 days after the date it is enacted into law.
This act is ordered to take immediate effect.

I need to match up sections to the proper enacting dates, but I wanted to let everyone know the good news.

    1. Just don’t carry it for 90 days if I am reading the language correctly.

    Does HB 245 mention, or repeal what the blade length has to be? Also according to Michigan knife laws, a person is prohibited from carrying a stiletto. is an Italian style knife a “stiletto”, and therefore illegal after SB 245 is in effect?

    1. Stilettos (long double edged daggers) remain illegal despite the bill. This includes the classic Italian “west side story” style switchblade stiletto.
